DUI License Suspension & SR-22 Insurance



Request for Hearing

In Washington State, drivers are deemed to have given their “implied consent” to a test of alcohol concentration. An officer who has reasonable cause to believe the driver is under the influence may request the driver submit to testing for alcohol concentration. Therefore, if a driver refuses the test or has an alcohol concentration of above .08, the privilege to drive may be suspended independent of any criminal prosecution.

To challenge the suspension, it is vital to submit the appropriate form to the Department of Licensing (“DOL”) within 30 days of the date of arrest (or 30 days from the date of notice in instances where blood is tested) to request a hearing. Usually, the arresting officer will provide the driver with the form. If the officer did not provide the form, one can be obtained through the Department of Licensing’s website or from this office. The fee imposed by the Department of Licensing for the hearing request is $200.00.

90 day suspension (BAC <.15)

A driver whose license is suspended for 90 days may be allowed to apply for an occupational or "temporary restricted" license after serving 30 days of the suspension, but the DOL will not issue the license unless the vehicle is equipped with an ignition interlock device (a device used to measure a driver's alcohol concentration and to prevent operation of the vehicle if concentration is too high). The driver must also file "proof of financial responsibility" (SR-22 insurance) with the DOL before a temporary restricted license will issue. SR-22 insurance is required for three years.

SR-22 Insurance

SR-22 insurance, also referred to as high-risk insurance, is mandatory for certain drivers as provided by statute. Premiums are much higher than standard insurance. A driver will be obligated to obtain SR-22 insurance for a period of 3 years following a DUI conviction or a Reckless Driving conviction. A driver must also obtain SR-22 insurance after an administrative suspension of the license by DOL.
