Negligent Driving 2nd Degree

Negligent driving in the Second Degree is defined as driving in a manner likely to endanger persons or property. Negligent Driving in the Second Degree is not a crime. It is a serious traffic infraction with a monetary penalty of up to $250.00 excluding assessments.

License: A committed finding to an infraction of Negligent Driving in the Second Degree does not result in a mandatory license suspension; however, it may affect a driver’s insurance.

The level of “intentionality” is less than that required to prove a person guilty of the crime of Reckless Driving. In general, police officers cite drivers for Negligent Driving in the Second Degree when they feel the driving warrants more than a single ticket such as for speeding but less than a crime like Reckless Driving.
