DUI Penalties (Breath Test & No Breath Test; Not Refusal)

These charts show the mandatory minimum penalties for individuals convicted of Driving Under the Influence in the State of Washington. The charts are for those that provided a breath test or in rare cases where a breath test was not offered. This also includes blood test DUI cases. These charts do not include the penalties for those that refused the breath or blood test when either of those were requested by law enforcement during the DUI investigation. For that information proceed to the DUI Refusal Penalty section.
